Hand & Checked Baggage

  1. Reference is made to FY GCC Passenger & Baggage Clause 8, sub-clause 8.9.
  2. Pursuant to the above mentioned sub-clause 8.9, passengers who are found to have carried with them hand baggage (unchecked baggage) exceeding the allowed piece, dimension and/or weight, shall be imposed a charge (please refer to the Fees Schedule) and the excess hand baggage will be checked-in prior to boarding of the aircraft. Payment for such charge shall be made in cash.
  3. Firefly will make every attempt to transport excess hand baggage checked-in from the gate on the same flight as the passenger. This is however further subject to operational requirements.
  4. Firefly will not be liable for any loss due to lost/delayed/pilfered/damaged unchecked baggage claimed or suffered by the passenger.
  5. Passengers who are found to have carried with them hand baggage (unchecked baggage) exceeding the allowed piece, dimension and/or weight and who refuse to check-in their excess hand baggage at the boarding gate will be subjected to FY GCC Passenger & Baggage Clause 7, Sub-Clause 7.1(e).

Terms & Conditions for online seat selection

  1. Passenger can book preferred seats with travel companions;
  2. If passenger chooses not to select a seat, the airline will automatically assign vacant seat/s to the passenger and travel companions at the point of check-in. There is no guarantee that the passenger and travel companions will be seated together and would be given seat preference;
  3. A charge will be levied for every seat selection. Please refer to our fee schedulefor further information;
  4. Fees are non-refundable;
  5. Available at least 2 hours prior to flight departure.
  6. Seats are assigned separately for outbound and return flights;
  7. Fees are non-transferable to another booking;
  8. The airline reserves the right to block off selected seats;
  9. Seat requests may not be accommodated at check-in if passengers do not meet the criteria on emergency exit row seats;
  10. Some exit row seats cannot be reclined as they would obstruct access to the exit;
  11. For safety reasons, passengers travelling with infants are only allowed to occupy certain seats. If there is more than 1 infant seated in a row, passenger may be moved by cabin crew for safety reasons;
  12. Passengers with medical conditions are advised to contact Call Centre to arrange for their seat selection and for other special assistance requests;
  13. If flight has been cancelled due to circumstances beyond our control or in cases of aircraft change for operational reasons, the airline will make best effort to place the passenger in the same or similar seats on the alternate flight.

Terms & Conditions on Emergency Exit Row Seats

  1. Passenger must be at least 18 years older;
  2. Passenger must be able to understand and carry out instructions which will be given in English onboard the flight;
  3. Passenger must be able to speak in English;
  4. Passenger must not be travelling with someone that requires his/ her assistance in an emergency;
  5. Passenger must be fit and able-bodied;
  6. Passenger must not have any permanent or temporary impairment (e.g. deaf, hearing impaired, blind, vision impaired, any strength or mobility limitation or intellectual impairment);
  7. Passenger must be able to check outside conditions and react to crew commands;
  8. Passenger must be able to reach, open, lift and throw out the exit door in an emergency;
  9. Passenger must acknowledge the exit row briefing given by Cabin Crew once onboard the aircraft;
  10. Passenger must be willing to help or assist cabin attendants in the unlikely event of an evacuation/ emergency situation;
  11. Passenger must not be seated with an infant;
  12. Passenger must not require the use of an extension seat belt;
  13. Passenger must not be elderly.

Terms & Conditions for In-flight Products

  1. The provision of in-flight products is subject to availability.
  2. In-flight products or are non-refundable and non-transferable once purchased.
  3. The airline does not accept any bookings or changes to in-flight products within 24 hours from the scheduled flight departure time.
  4. The boarding pass is proof of purchase of pre-booked products or meals and must be presented to the cabin crew onboard to redeem the pre-booked products.
  5. All prices quoted for pre-booked products are correct at the time of booking. However, the airline reserves the right, without prior notice, to amend/change the prices or substitute any component of the pre-booked products.

Taxi Booking Service

  1. “Passenger”, “you”, “your” and “yourself” means any person booking a service for taxis through www.fireflyz.com.my
  2. “We”, “our”, “ourselves”, and “us” means Firefly.
  3. Passenger booking a taxi through www.fireflyz.com.my (the “Taxi Booking Services”) will be subject to a Taxi Booking Fee of Six Ringgit Malaysia (RM6) per taxi payable to Firefly.
  4. Passengers will separately be subject to a meter charge plus a fixed and regulated surcharge, if applicable, for the subsequent taxi service payable to Sunlight Taxi Sdn Bhd and be subject to Sunlight Taxi Sdn Bhd’s terms, conditions and regulations relating to taxi charges for travel from the Passengers’ point of origin to Sultan Abdul Aziz Shah Airport, Subang Skypark Terminal (“Subang Airport”).
  5. Taxi Booking Services are only available for one-way transportation from the Passenger’s pick-up point (which shall be within Kuala Lumpur and Selangor, Malaysia only) to Sultan Abdul Aziz Shah Airport, Subang Skypark Terminal (“Subang Airport”) only.
  6. When making a Taxi Booking Service, you must select a pick-up time that ensures you arrive at the airport with sufficient time to check in:
    • Check-in counters at Subang Airport: open one and a half (1.5) hours and close thirty (30) minutes before estimated time of departure;
    • You are responsible for presenting yourself at the check-in counters not later than the time set out above;
    • We will not be liable to you for any loss or expense you suffer if you fail to meet check-in deadlines, fail to present yourself for check-in on time or fail to be at the boarding gate on time.
  7. We are ONLY providing to you a Taxi Booking Service through www.fireflyz.com.my. The taxi services are provided solely by Sunlight Taxi Sdn Bhd and Sunlight Taxi Sdn Bhd shall be solely responsible towards you for the taxi services and in all matters pertaining thereto.

    We shall not be liable for any delay, loss, injury, or damage to you, including the missing of your flight if such delay, loss, injury, or damage is caused by the acts or omissions of Sunlight Taxi Sdn Bhd or relating to the taxi services.

  8. The taxi services are subject to the conditions of carriage of Sunlight Taxi Sdn Bhd applicable to such transportation in force from time to time as published in Sunlight Taxi Sdn Bhd’s tariffs, timetables or notices.
  9. A Taxi Booking Service made through www.fireflyz.com.my is confirmed only after you complete your online flight booking and the required payment(s) is/are made and we have issued you a confirmed booking number and flight itinerary.
  10. Once your Taxi Booking Service is confirmed, said booking cannot be cancelled and all payment(s) related to said Taxi Booking Service are not refundable.
  11. It is your responsibility to make all appropriate changes or amendments to your Taxi Booking Service details with Sunlight Taxi Sdn Bhd where necessary including, where such changes or amendments are required due to a change in your flight schedule. You will need to call Sunlight Taxi Sdn Bhd’s 24-hour Call-Centre directly to make all such changes or amendments.
  12. Availability of taxi (s) will not be guaranteed by Firefly for pick-up-time reschedule request by passenger.
  13. The taxi fare charged by Sunlight Taxi Sdn Bhd, which is a meter charge plus a fixed and regulated surcharge from the passenger’s point of origin to their destination such as Skypark Terminal in Subang, will not be reimbursed by Firefly in case of flight delay, cancellation or flight schedule change. Your rights relating to such delay, cancellation or flight schedule change and your air carriage shall be subject to prevailing policies, regulations and conditions of carriage as may be set out in the respective Firefly Ticket or such other document evidencing the same, unless expressly notified otherwise by Firefly.
  14. No cancellation of taxi bookings will be done by Firefly.

Prepaid Change Fee

  1. “Passenger”, “you”, “your” and “yourself” means any person purchasing the Prepaid Change Fee through www.fireflyz.com.my
  2. “We”, “our”, “ourselves”, and “us” means Firefly.
  3. A Prepaid Change Fee (“Prepaid Change Fee”) is a fee imposed on Passengers who wish to reserve their option to change the flight date or flight time (the “Change”) of their flight itinerary.
  4. The Prepaid Change Fee is offered to Passengers purchasing their flight online through www.fireflyz.com.my
  5. Prepaid Change Fee can only be purchased outside of fourty-eight (48) hours prior to scheduled flight departure time;
  6. The Prepaid Change Fee Structure is as outlined in our Fee Schedule
  7. Passengers purchasing the Prepaid Change Fee online shall be subject to the following conditions:
    • Change shall only be allowed outside of two (2) hours prior to scheduled flight departure time;
    • Once payment for Prepaid Change Fee has been made, such payment is non-cancellable, and non-refundable;
    • Prepaid Change Fee is applicable for one (1) change only; i.e. one flight date or one flight time change despite both changes occurring on the same flight;
    • Where Passenger has bought a return ticket, change is only allowed on one route only, i.e. either flight date or flight time change on Passenger’s outbound flight or on Passenger’s inbound flight;
    • If a lower fare is available, the difference in fares will not be refunded to the Passenger;
    • If the new flight booked is in a higher fare class than that of the cancelled booked flight, the difference in fares shall be paid by the Passenger before the cancellation or change can be made;
    • Changes are subject to fare rules.
  8. A Prepaid Change Fee made through www.fireflyz.com.my is confirmed only after you complete your online flight booking and the required payment(s) is/are made and a confirmed booking number and flight itinerary has been issued via email confirmation.
  9. The Change is not confirmed until a new itinerary and/or booking number is issued via email confirmation.
  10. Whilst payment for the Prepaid Change Fee is made online, change of flight date or flight time shall be made by calling Firefly Call Centre at Tel : +60 (3) 7845 4543 (Operating Hours: Daily 8:00am – 9:00pm).
  11. All the above are subject to Firefly’s General Conditions of Carriage.

Donation for the Connecting Communities Programme

Effective 4 February 2014:

By checking the box, it is deemed that you have elected to give a donation (“Donor”) in response to the Connecting Communities Programme (the “Programme”), and have read and agreed to be bound by the following terms and conditions. If you wish not to participate in the Programme or do not agree to be bound or cannot comply with any of the terms and conditions, please do not participate in this donation by unchecking the box.

  1. Introduction
    • Thank you for contributing to the Programme (“Donation”). Your Donation shall be made to the Malaysian Aids Foundation (MAF).
    • The Donation period is from 4 February 2014 until 7 May 2014 (the “Donation Period”)
    • This Donation is open to customers of FlyFirefly Sdn Bhd (“FY”) who purchase FY flight ticket(s) via www.fireflyz.com.my during the Donation Period.

     
  2. Terms of your Donation
    • The amount of RM1.00 per purchase transaction will be remitted by FY to MAF. This amount excludes the total price of the flight ticket fare(s).
    • Your Donation is immediate and irrevocable upon confirmation; accordingly, FY cannot refund or cancel your Donation made for any reason whatsoever.
    • FY will collect your Donation and remit the same to MAF at no further administrative costs. FY is not liable for any delays related to the transmission of Donation to MAF. For clarity, MAF has the exclusive legal control over all Donation amounts.
    • FY reserves the right to cancel, terminate or suspend this Programme without any prior notice. For the avoidance of doubt, any cancellation, termination or suspension by FY of the Programme shall not entitle the Donor to any claim or compensation against FY, its agents and employees for any and all losses or damages suffered or incurred as a direct or an indirect result of the act of cancellation, termination or suspension thereof.
    • FY shall not be liable for any disruption during the Donation Period, whether due to technical problems or otherwise.
    • Donor understands and agrees that the Donation through FY shall be at Donor’s own discretion and risk. FY, its agents, employees, representatives, affiliates, parents and subsidiaries shall not be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential losses) or personal injury suffered or sustained in connection with or arising from participation in this Donation.
    • Donor agrees to indemnify and hold harmless FY and its agents, employees, representatives, affiliates, parents and subsidiaries (“Indemnified Party”) from and against any and all claims, actions, demands, causes of action and other proceedings arising from or concerning Donor use of the service (collectively “Claims”), and to reimburse the Indemnified Party on demand for any losses, costs, judgments, fees, fines and other expenses the Indemnified Party incur as a result of any Claims.
    • FY expressly disclaim to the fullest extent permitted by law all express, implied, and statutory warranties, including without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.
    • All information submitted by Donor in participation of the Donation shall belong to FY. All personal data collected pursuant to the Donation will not be used nor published save for the purpose of flight booking.
    • FY reserves the right to vary, delete or add to any of these terms and conditions without prior notice or liability to you, any other user or any third party. Please review these terms from time to time so that you will be apprised of any changes. Use of this service following a change to the terms constitutes agreement to the new terms. If you cannot comply with the amended terms, your only remedy is to cease any future donations.
    • These terms and conditions contain the complete agreement between FY and Donor with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings or representations contained in any other promotional materials advertising the Programme, whether oral or written.
    • The failure or delay of FY to exercise any of its rights under these terms or upon any breach of this terms and conditions shall not be deemed a waiver of those rights or of the breach.
    • This terms and conditions shall in all respect, include all matters of construction, validity and performance be governed by, construed and enforced exclusively in accordance with the laws of Malaysia. FY and Donor shall submit to the exclusive jurisdiction of the Malaysian courts.
    • If any provision of this terms and conditions shall be held by a court of competent jurisdiction to be contrary to law, such provision will be enforced to the maximum extent permissible and the remaining provisions of these terms and conditions will remain in full force and effect.

PEUGEOT LOUNGE ONLINE BOOKING SERVICE

BY MAKING A BOOKING FOR THE ENTRY AND USE OF PEUGEOT LOUNGE FACILITIES, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS. PLEASE READ THEM CAREFULLY BEFORE YOU PROCEED WITH YOUR BOOKING.

  • GENERAL
    1. These terms and conditions ("Terms and Conditions"), as may be amended from time to time, apply to all bookings made available online via Firefly Website for the entry and use of the Peugeot lounge, which is located in Subang Skypark Terminal, Sultan Abdul Aziz Shah Airport (referred as the "Lounge"), by Firefly passengers. By accessing, browsing and using our website or any of our applications through whatever platform and/or by completing a booking, you acknowledge and agree to have read, understood and agreed to these Terms and Conditions set out below.
    2. The booking confirmation issued by us confirming your booking ("Booking Confirmation") shall constitute a legally binding contract between you and Nasim Sdn Bhd and shall be further supplemented by the Lounge’s terms of use that apply.
    3. In these Terms and Conditions,

      "Passenger", "you", "your" and "yourself" means any person booking the Lounge Service through Firefly Website;

      "Firefly", "We", "our", "ourselves", and "us" means FlyFirefly Sdn Bhd (346606-K);

      "Peugeot Lounge" means Nasim Sdn Bhd (441264-U);

      "Lounge" means the Peugeot lounge operated and managed by Nasim Sdn Bhd located at Subang Skypark, Sultan Abdul Aziz Shah Airport;

      "Lounge Service" means any non-chargeable facilities and services provided by Peugeot Lounge to you;

      "Website" means the website and webpage owned, operated and managed by FlyFirefly Sdn Bhd known as http://www.fireflyz.com.my.
  • ONLINE BOOKING
    1. Bookings may be made only online via Firefly Website.
    2. Full payment must be made at the time of booking. We accept payment by Visa or Mastercard credit/debit cards or FPX payment. The available payment options are displayed during the booking process on Firefly Website. A payment processing fee may apply.
    3. Once your booking has been successfully completed, a Booking Confirmation will be issued and sent to the email address provided by you. You MUST produce your boarding pass, travel itinerary or Booking Confirmation upon entering the Lounge, together with your original valid photo identification document (national registration identity card, passport, driver's licence or other identification card or document as Peugeot Lounge may require). If you do not receive your Booking Confirmation within twenty-four (24) hours from the time of booking, please contact Firefly Call Centre at +603 7845 4543.
    4. During the booking process, you will be advised to ensure the accuracy of your booking details (full names, Malaysian I/C or foreign passport details, booking reference numbers, flight details, etc). We will not be responsible or liable for errors in booking details.
    5. Bookings are subject to occupancy capacity of the Lounge and Peugeot Lounge reserves the right to refuse entry due to full load capacity as further detailed below.
    6. Booking is only available for flights departing from or arriving at Sultan Abdul Aziz Shah Airport, Subang Skypark Terminal (“Subang Airport”) ONLY. The Lounge is only available for use only at Subang Airport.
  • BOOKING FEE/CHARGE
    1. Bookings are subject to such fees/charges based on the displayed rate during the flight booking process and in Manage My Booking.
    2. Booking fees/charges may include service tax, service charge, Goods & Services Tax (GST), where applicable, and/or other similar charges or tax subject to the requirements of the applicable law.
    3. Once your booking is confirmed it cannot be cancelled and is non-refundable. Any refunds shall be made subject to these Terms and Conditions.
    4. No changes to the Lounge booking are allowed. However, should you change your flight time and flight date, the booking of your Peugeot Lounge will follow suit.
    5. If you wish to make a Lounge booking at a later stage after you have confirmed your flight booking, you may do so by contacting Firefly Call Centre at +603 7845 4543 or via Manage My Booking.
  • RESTRICTIONS
    1. The Lounge is subject to maximum capacity limitations. You agree that entry to the Lounge shall be permitted on a “first come, first served” basis and that once the space allocated for admittance reaches full capacity, Peugeot Lounge shall have the right to refuse your entry. In such case, you may either return at a different time or request for a refund pursuant to Clause F.1 below (Please refer FAQ for further details).
    2. The following restrictions apply to the use of the Lounge:
      • No pets or any other animals shall be allowed
      • No smoking allowed
      • No outside food and drinks shall be allowed
      • No alcohol allowed
    3. The Peugeot Lounge may remove and/or confiscate any of the above items found in the Lounge immediately without notice to you and to charge you for any costs incurred for taking such action or for any loss or damage caused to Peugeot Lounge, the Lounge staff and premises or to any other guests or third party as a result of your failure to comply with this policy.
    4. Peugeot Lounge further reserves the right to ask you to leave the Lounge and immediately if they, in their sole opinion, deems that you have used the Lounge in an irresponsible manner or in a manner that will compromise the safety of, or cause damage and/or harm to the Lounge premises, the other guests, our staff or any other persons or the reputation of Peugeot Lounge, without any compensation and/or any reimbursement to you.
  • OPERATING HOURS
    1. The Lounge will be available for use by the guests from [6.00am until 8.00pm]. However, you may only enter and use the Lounge within [three (3) hours] prior to your scheduled flight departure from or within the same day of your flight arrival at Subang Airport. (Please refer FAQ for further details)
    2. In the event of no-show, no refunds or postponement will be entertained.
  • DAMAGE
    1. You are liable for any damage howsoever caused to the Lounge or to the premises caused by you during the use of the Lounge. We reserve the right to claim compensation or make good the loss, damage, costs or expenses incurred or suffered by us as a result of the aforesaid. Regardless, we further reserve the right to commence legal proceedings against you without notice.
  • RIGHT TO REFUSE ENTRY
    1. Peugeot Lounge reserves the right to refuse your entry in the event the Lounge reaches its full capacity for admittance. In such event, you may either return at a different time or you may request for a refund of the booking fee/charge paid pursuant to Clause B.1 above by emailing us at customer_care@fireflyz.com.my.
    2. Peugeot Lounge reserves the right to refuse your entry or any person(s) without any notice and terminate any booking without being liable for any refund or compensation for the following reasons:
      • the booking has been paid through fraudulent means
      • the booking has been altered by anyone other than us or our authorised agent or has been tampered with or the Booking Confirmation has been defaced (in which case Peugeot Lounge reserves the right to retain such booking documentation)
      • the person checking in is not or cannot prove that he/she is the person named in the Booking Confirmation
      • as permitted under the provisions of these Terms and Conditions
  • LIMITATION OF LIABILITY
    1. Peugeot Lounge is responsible for providing the Lounge facilities and services stated in the Booking Confirmation(s) in accordance with these Terms and Conditions. We do not accept any liability for failure to provide the services contracted or any of them due to circumstances beyond our control.
    2. Subject to the limitations set out in these Terms and Conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to the online booking services, up to an aggregate amount of the aggregate cost of your booking as set out in the confirmation email (whether for one event or series of connected events).
    3. To the extent permitted by law, we shall not be liable for any event arising out of any occurrences beyond our control including but not limited to acts of terrorism, acts of God, flood, war, strikes, riot, theft, delay, cancellation, civil disaster, government regulations or changes in itinerary or schedule (collectively, “Force Majeure”).
    4. Without affecting any statutory consumer rights or other laws that cannot be lawfully excluded or limited, we shall not be liable for loss of any kind whatsoever arising out of, caused by, attributable to or resulting from your booking, use of the Firefly Website or use of the Lounge even if caused or contributed to by Peugeot Lounge’s negligence, wrongful act / omission or breach of these Terms and Conditions or breach of duty or otherwise.
    5. All activities have inherent risks to health and safety and we shall not be responsible for any eventualities related to any activities or services booked through the Firefly Website or during use of the Lounge.
    6. We shall not be responsible for any loss or damage of property left in the Lounge premises. You are advised to obtain insurance to cover curtailment, and loss of luggage, personal effects, damages, personal injury and money/valuable belongings.
  • PRIVACY & DATA PROTECTION
    1. We will retain all personal information you provide during booking. By making a booking with us or using the Firefly Website, you consent to our use and/or disclosure of your personal details to our affiliates, assignees, proposed assignees, agents, commercial partners, service providers and/or any other parties engaged by us to enable or assist us in the provision of services or to exercise or enforce our rights hereunder and/or any other party as we may, in our sole and absolute discretion, deem necessary for the following purposes:
      • to process your booking and for other administrative purposes
      • to provide you customer support and services
      • to send you information on products and services, and special or promotional offers, newsletters or customer survey forms and questionnaires. You may unsubscribe from these at any time by clicking on the "unsubscribe link" on the relevant email communications.
    2. We may also be legally obliged to disclose, and you irrevocably consent to our disclosing, your personal information to government and enforcement agencies, regulatory bodies and public authorities or as may be required by law. This may involve sending your personal information between different countries.
    3. We will use our best endeavours to use your personal information in the manner stated herein and will not otherwise disclose your personal information without your prior written consent.

  • COPYRIGHT & TRADE MARKS
    1. The Firefly Website including the booking and other applications, text, graphics, designs, audio and video clips, information and all other content thereon are the property of Firefly and/or Peugeot Lounge.
    2. You may use the Firefly Website and its content solely for personal, non-commercial and private use subject always to applicable copyright laws.
    3. All trademarks, trade names, service marks and all other marks, whether registered or unregistered, on the Firefly Website are owned by or licensed to Firefly and their respective owners and may not be used, reproduced or modified without our prior written approval.
  • DISCLAIMER
    1. The Firefly Website, the online booking services provided and all content thereon are supplied "as is" and "as available". We provide no guarantee regarding the website and its content. You are solely responsible for your own use thereof.
    2. While we will make every effort to ensure that the information on Firefly Website is accurate and published in good faith. Without affecting any statutory consumer rights that cannot be lawfully excluded or limited, we do not warrant or represent the accuracy of the information displayed and disclaims to the maximum extent permitted by law all warranties expressed or implied by statute, custom or usage.
    3. We shall not be liable for any direct, indirect, consequential, punitive losses or damage (including without limitation loss of revenue, loss of goodwill, loss of reputation and loss of, or damage to data), arising out of the use of Firefly Website or the use thereof or the online booking services purchased from the Firefly Website, or any errors, inaccuracies or omissions in the services or content provided howsoever caused.
